Petitioner is apprehending his arrest in connection with Uphara PS Case No. 32/2017 for the offence under Section 420/406 of the Indian Penal Code.

Learned counsel for the petitioner submits that allegation against the petitioner is that he returned the CMR to the respective farmers without any decision of the competent authority. There is no allegation of any misappropriation of fund or embezzlement of rice against the petitioner. He further submits that the petitioner has no criminal antecedent. Considering the aforesaid, the petitioner above named, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail

Patna High Court Cr.Misc. No.49614 of 2018(2) dt.12-12-2018 2/2 on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Uphara PS Case No. 32/2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
