The petitioner seeks bail in connection with Musarigharari P.S. Case No.68 of 2023, registered for the offence punishable u/s 304B/34 of the IPC and 3⁄4 of D.P. Act. 3.

Allegation against the petitioner is that he along with other co-accused persons killed the daughter of the informant due to non-fulfillment of demand of dowry.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. No such occurrence, in the manner as alleged, has ever taken place. He has been falsely implicated in this case due to ulterior motive. Petitioner is husband of the

Patna High Court CR. MISC. No.76659 of 2023(5) dt.10-05-2024 2/2 deceased and he used to reside outside of the village for earning livelihood. He has neither made any dowry demand nor have ever tortured the deceased for the same. There is general and omnibus allegation against the petitioner. The petitioner has no criminal antecedent and has been languishing in custody since 27.05.2023.

Learned APP for the State opposed the prayer for bail by submitting that petitioner is the husband of the deceased and there is allegation against him, as the onus to take care of his wife in the matrimonial house, was upon him.

Considering the facts and circumstances of this case and the nature of allegation, I am not inclined to grant bail to the petitioner. His prayer for bail is hereby rejected. (Anjani Kumar Sharan, J) pallavi/- U T
