JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-11-2025 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioner seeks bail in a case registered for offence under Sections 103(1), 103(2) and 61 of the B.N.S., 2023.
3. The informant alleges that co-accused Rajesh Yadav along with four accused came to his house and asked him to accompany them along with his son and both the laptops, accordingly the informant along with his son and both the laptops accompanied them and reached their house, where several accused persons including petitioner were already present. The informant further alleges that the accused persons took his son to other side, where seven unknown accused were

No.71767 of 2025(2) dt.12-11-2025 2/3 present from before and the accused snatched the laptop and tied his son in a room and put clothes in his mouth, thereafter took out all his nails from the legs and co-accused Rajesh Yadav stabbed him while co-accused Vijay Yadav gave electric shock and the accused left his son in an injured condition and asked the informant to take his son away or else he would be killed. Subsequently, son of informant succumbed to his injuries.

Learned counsel for the petitioner submits that as per F.I.R. itself, specific accusation of inflicting knife in the abdomen of son of informant is against co-accused Rajesh Yadav and thereafter, giving electric shock to him (informant's son) is against co-accused Vijay Yadav. So far as this petitioner is concerned, there is no specific allegation of assault against him. Similarly situated co-accused persons have already been granted bail by a coordinate Bench of this Court, vide order dated 17.10.2025 passed in Cr.Misc. No. 56517 of 2025. Petitioner has got clean antecedent and is in custody since 12.06.2025. Chargesheet has been submitted.
5. Learned A.P.P. for the State and learned counsel for the informant opposed the prayer for bail of petitioner.
6. Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be
Patna High Court CR. MISC. No.71767 of 2025(2) dt.12-11-2025 3/3 released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Sitamarhi in connection with Dumra P.S. Case No. 171 of 2025.
