JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-12-2019 This application, for grant of anticipatory bail, arises out of Ballia P.S. Case No. 230 of 2019, disclosing offences under Sections 302, 201 and 34 of the Indian Penal Code.
Petitioner no. 1 is the mother in law of the daughter of informant, petitioner no. 2 is the father in law and petitioner nos. 2 and 4 are sister in law and brother in law of the daughter of informant and allegation against them is of causing death of the deceased.
Submission of learned counsel for the petitioners is
Patna High Court CR. MISC. No.69458 of 2019(3) dt.09-12-2019 2/2 that there is no eye witness of the occurrence and they have falsely been implicated in this case and no specific allegation has been attributed to them and some of the witnesses have stated before the police in course of investigation that the girl has fled away.
Learned counsel for the State opposed the prayer for anticipatory bail to the appellants, however, he could not point out any specific allegation against the petitioner though case diary is available with him.
Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Ballia P.S. Case No. 230 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
