JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Petitioners seek bail in anticipation of their arrest in connection with Bathnaha P.S. Case No. 156 of 2019 registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a),(c) of Bihar Prohibition and Excise Act.

As per FIR there was recovery of 44.250 and 4.5 litres of liquor from Maruti Car and motorcycle respectively and it is said that petitioners succeeded in fleeing away. Submission of learned counsel for the petitioners is that they are not the owners of the vehicles and they have nothing to do with the seized article and except confessional statement there is nothing against them and they have no

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional District Judge-II-cum-Special Judge, Excise Act, Sitamarhi, in connection with Bathnaha P.S. Case No. 156 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
