Petitioner is apprehending his arrest in Khaira P.S.Case No.210 of 2017 registered for the offences under Section 392 of I.P.C.

Petitioner is not named in the F.I.R. but later on his name transpires during course of investigation on the basis of confessional statement of co-accused Sajan Kumar. Submission of the learned counsel for the petitioner is that except confessional statement of co-accused there is nothing against him. He has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within a

Patna High Court Cr.Misc. No.48345 of 2018 (2) dt.23-08-2018 2/2 period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Jamui, Khaira P.S. Case No.210 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in the investigation of the case and make himself available as and when required by the police, otherwise, the prosecution is free to move for cancellation of his bail bond.
