====================================================== CORAM: HONOURABLE MR. JUSTICE AJIT KUMAR ORAL ORDER 27-11-2025 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the University.

2. The instant writ petition has been filed for the following reliefs:- "1. (i) That the petitioner above named craves for indulgence of this Hon'ble court by way of issuance of an appropriate order/orders, direction /directions or writ/writs preferably in the nature of mandamus.

(ii) To issue an order/ orders, direction to pay the amount of retirement benefits since date of his appointment (28.08.1970) as a Lecturer in Ma thematic in B.M.Α. College, Baheri under control and guidelines of Lalit Narayan Mithila University.

(iii) To issue an appropriate writ/writs, order/orders, direction/directions

Patna High Court CWJC No.17210 of 2025(2) dt.27-11-2025 2/3 to the respondent concern to treat the appointment of petitioner as a Lecturer since 28.08.1970 and not as 23.10.1977.

(iv) To grant any other relief reliefs as this Hon'ble Court may deem fit and proper."

Learned counsel for the petitioner, at this stage submits that the petitioner was appointed as a Lecturer in Mathematics in B.M.A College, Baheri, Darbhanga on 28.08.1970 on the first post and appointment should be treated w.e.f. 28.08.1970 and not from 23.10.1977 and by treating his services from 23.10.1977 the pension and pensionary benefits have been settled, which is not in consonance with the law.

4. On the other hand, learned counsel representing L.N. Mithila University, Darbhanga submits that the petitioner may be directed to file appropriate representation with all supportive materials, before the Vice Chancellor, L.N. Mithila University, Darbhanga, within a timeline so fixed by this Court.

5. Considering the aforesaid, the petitioner is directed to submit detailed representation within a period of four weeks and on submission of such representation the

Patna High Court CWJC No.17210 of 2025(2) dt.27-11-2025 3/3 claims are required to be adjudicated by the concerned authority and if on adjudication the claims of this petitioner are found justified, necessary orders shall be passed within a period of six weeks and benefits for which this petitioner is entitled shall also be extended within the same time.

6. Accordingly, the instant writ petition stands disposed of.
