JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Nautan P.S. Case No. 183/2019 registered for the offences punishable under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

Although petitioner was not caught on the spot but coaccused Rahul Kumar Singh, who was caught on the spot with illicit liquor, disclosed the name of the petitioner and claimed that when police party intercepted the vehicle, petitioner managed to escape from there.

In view of the above stated facts, this anticipatory bail petition is not maintainable.

Patna High Court CR. MISC. No.66953 of 2019(2) dt.27-11-2019 2/2 Accordingly, this petition stands dismissed being not maintainable.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
