JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2020 This application, for grant of anticipatory bail, arises out of Shahpur P.S. Case No. 288/2019, disclosing offences under Sections 147, 341, 323, 379, 504 and 307 of the Indian Penal Code.

Allegation against the petitioners and others is of assaulting the informant and threatening to kill him. Submission of learned counsel for the petitioners is that there is case and counter case between the parties and only

Patna High Court CR. MISC. No.72250 of 2019(2) dt.17-01-2020 2/2 general and omnibus allegation has been levelled against the petitioners and although, there is allegation of assault, injuries sustained by the informant was found simple in nature, which is evident from annexure -2 of the petition.

Heard learned A.P.P. also as well as learned counsel for the informant, who has appeared suo motu. Learned counsel for the informant has submitted that petitioners brutally assaulted the informant causing damage of his retina. Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Danapur, Patna, in connection with Shahpur P.S. Case No. 288/2019, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.
