Petitioner apprehends his arrest in connection with Kotwali P.S.Case No. 95 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307 and 302 of the Indian Penal Code.
Allegation against the accused persons, including the petitioner is of assault to the deceased.
Submission of learned counsel for the petitioner is that there was land dispute between the informant and one Madari Yadav and petitioner happens to be brother of Madari Yadav. Further submission is that a case has been lodged by the petitioner's side against the informant.
Heard learned APP and learned counsel for the
Patna High Court Cr.Misc. No.49441 of 2018 (2) dt.29-08-2018 2/2 informant. They have opposed the prayer for anticipatory bail on the ground that some of the injuries found on the person of deceased were grievous in nature.
Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
