JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-11-2019 The petitioner apprehends his arrest in connection with Lodipur P. S. Case No. 89 of 2017 registered under Sections 201 and 302 of Indian Penal Code which was later on converted into under Section 306/34of the Indian Penal Code. The prosecution story in brief is that husband of informant was killed by some unknown persons. Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the FIR and FIR was lodged against unknown. He further submits that during the course of investigation, it has come to light that deceased has committed suicide due to the fact that petitioner was having some relationship with the wife of the deceased. Patna High Court CR. MISC. No.65273 of 2019(2) dt.04-11-2019 2/2 taking into consideration the fact that petitioner is not named in the FIR and from perusal of FIR itself, it is evident that deceased has committed suicide, as such I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Bhagalpur in connection with Lodipur P.S.Case No. 89 of 2017; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
