The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 448, 341, 323, 324, 380, 604, 506 and 34 of the Indian Penal Code pending in the learned court below.

Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. He further submits that there is general and omnibus allegation against the petitioners. He submits that there is no specific overt act against the petitioners. He further submits that petitioners and the informant come form the common family

Patna High Court CR. MISC. No.71940 of 2022(2) dt.17-03-2023 2/2 and there is land dispute used to take place between them. He further submits that petitioners have got one criminal antecedent as stated in para-3 of the bail application.

Per contra, learned APP for the State vehemently opposing the bail application and submitted that the there is specific allegation levelled against the petitioners of demanding the Rangdari from the informant. Hence, they do not deserve anticipatory bail.

Considering the facts and circumstances of the case and the nature of the offence, I am not inclined to enlarge the petitioners on bail in connection with Bakhri P.S. Case No. 201 of 2022. Accordingly, their prayer for anticipatory bail is hereby rejected.
