2. In the present case, the petitioner seeks bail in connection with Ujiarpur P.S. Case No. 303 of 2024, registered for the offences under Section 310(2) of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, threatening the informant with knife and gun six miscreants snatched his wallet containing Rs. 4000/-, backpack containing Rs. 5 lakhs, micro ATM machine, POS machine apart from a number of ATM cards, cheque book, mobile phone etc. The name of the petitioner transpired during investigation for being involved in the occurrence.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.70433 of 2025(2) dt.14-10-2025 2/3 petitioner submits that petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the conscious possession of the petitioner. The name of the petitioner transpired from the confessional statement of the co-accused person and except the confessional statement, there is no material against the petitioner. The petitioner has no criminal antecedent and is in custody since 15.05.2025. The charge-sheet has been submitted.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the fact that no recovery has been shown from this petitioner and further considering the clean antecedent of the petitioner, period of custody and submission of charge-sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge, Dalsingsarai, Samastipur in connection with Ujiarpur P.S. Case No. 303 of 2024 , subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
