The petitioner seeks bail in connection with Kundhani P.S. Case No. 449 of 2015, registered for offence punishable under Sections 420, 406 and 409 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that there was direction of Lokpal Manrega to stop from taking service from the then Panchayat Rojgar Sewak Rani Sanyukta and Junior Engineer and also take step against Mukhiya, Gram Panchayat, Raj Chandrahatti for their termination under Section 18(5) of the Panchayati Raj Act and recovery of amount of Rs. 459788.00 along with 12% annual interest from the then the

No.75276 of 2019(3) dt.03-12-2019 2/2 then Programme Officer, the then Panchayat Rojgar Sewak and Mukhiya equally and also lodge the case against District Programme Officer, Mukhiya, Panchayat Rojgar Sewak and Junior Engineer before Competent Authority for the alleged offence (Annexure-2). There was no direction for lodging the case against the present petitioner. The petitioner has no criminal antecedent and he is in custody since 28.06.2019. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 3rd (West) Muzaffarpur in connection with Kudhani P.S. Case No. 449 of 2015.
