====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 08-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks regular bail in a case registered under Section 30(a) of Bihar Prohibition and Excise Act.
3. As per prosecution case, there is recovery of 450 litres of illicit liquor from a Car bearing Registration No. PB02AL-6543. It is alleged that petitioner alongwith co-accused Pradeep Kumar Kamat were apprehended on the spot.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that petitioner is the driver of the vehicle in question and he had no knowledge with regard to what was kept in the seized Car. Learned counsel submits that petitioner has no concern with the alleged seized liquor. He further submits that no incriminating article has been recovered from the conscious possession of petitioner. Learned counsel submits that there is no

He further submits that petitioner is in custody since 05.07.2025, having one criminal antecedent of similar nature. Learned counsel submits that similarly situated co-accused, namely, Pradeep Kumar Kamat had already been granted regular bail by Co-ordinate Bench of this Court vide order dated 22.09.2025 passed in Cr. Misc. No.62644 of 2025. He further submits that there is no chance of absconding the petitioner or tampering with the evidence by him and he undertakes to cooperate in the investigation and trial.
5. Learned A.P.P. for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case, the submissions of learned counsel for the parties and period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with G.R. No.415 of 2025 arising out of Bhairoasthan P.S. Case No.95 of 2025.
