The petitioner seeks correction of certain words/figures as occurring in the judgment and order dated 02.03.2017 passed in C.W.J.C. No. 6 of 2016, the details are present in paragraph 3 of the modification application and which runs as under: "(i) In paragraph no.1 the counsel for the State have been mentioned as "S.C.-3" in place of "S.C.-24".
(ii) In paragraph no. 3 at page no. 2 in the 9th line it has been inadvertently typed as "23.07.2010" in place of "30.07.2010" (connected paragraph no. 13 of the writ petition) (iii) In paragraph no. 5 at page 4 it has been wrongly typed as "Memo no. 3282" in place of „3283".
(iv) In paragraph no. 12 at page no. 8 (4th line from bottom) it has been wrongly typed as Memo No. "3282" in place of "3283"."
I have heard Mr. Sinha, learned counsel for the petitioner and learned counsel for the State and while I find no infirmity
Patna High Court MJC No.1019 of 2017 (3) dt.16-05-2018 2/2 or typographical error as pointed out at paragraph 3(i) and 3(ii), in so far as typographical error at paragraph 3(iii) and 3(iv) are concerned, admittedly, the memo dated 06.06.2014 impugned at Annexure-1 to the writ petition has been wrongly mentioned as „Memo No. 3282‟ at page 4 and page 8 of the judgment in place of „Memo No.3283‟.
Accordingly, let the memo number of the impugned order dated 06.06.2014 as occurring at page 4 and 8 of the order dated 02.03.2017 passed in C.W.J.C. No. 6 of 2016 be modified to read as „Memo No.3283‟ in place of „Memo No.3282‟ and shall be deemed to have been pronounced accordingly.
The order is modified to the aforementioned extent. This application for modification is allowed. (Jyoti Saran, J) Bibhash U
