2. Petitioners seek regular bail in a case registered for the offence punishable under sections 103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per prosecution case, informant suspects that on account of land dispute, all the FIR named accused persons including these petitioners killed his father.
4. Learned counsel appearing for the petitioners submits that FIR has been instituted on suspicion. There is no eye witness to the occurrence. It appears that the deceased died due to drowning. During investigation, none of the witnesses claimed to have seen these petitioners committing the
Patna High Court CR. MISC. No.71347 of 2025(3) dt.02-12-2025 2/2 alleged offence. Charge sheet has already been filed. Petitioners are in custody since 19.7.2025.
5. Learned counsel for the State and the informant oppose the prayer for bail.
6. Considering the nature of accusation and period of custody of these petitioners, their prayer for regular bail is allowed. Let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- each (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Begusarai in Sahebpur Kamal Police Station Case No. 163/2025.
