JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-11-2019 The petitioners apprehend their arrest in connection with Hajipur (Town) P. S. Case No. 464 of 2019 registered under Sections 307, 323, 324, 341, 504 and 506/34 of the Indian Penal Code.
Allegation against the petitioners is that petitioners assaulted the father of the informant by means of Hasua and petitioner no. 2 caused injury on the private part of the informant's father.
Learned counsel appearing on behalf of the petitioners submits that informant and petitioner no. 1 are full-brother and victim is father of the petitioner no. 1. He further submits that there was a dispute relating to partition between the parties and petitioners no. 1 and 2 are husband and wife.

No.65277 of 2019(2) dt.04-11-2019 2/2 Having regard to the submissions made by the parties and taking into consideration the fact that informant and petitioner no. 1 are brothers and there appears to be a dispute relating to partition between them, I am inclined to grant anticipatory bail to the petitioners.
Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Hajipur Town P.S.Case No. 646 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
