JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 290 of the Indian Penal Code and Sections 30(a), 37(b)(c) of the Bihar Prohibition and Excise Act, 2016.

50 liters Mahua liquor is said to have been recovered from the house of the petitioner for which, petitioner is in jail custody since 19.08.2019.

Admittedly, petitioner was not arrested at the time of above stated recovery. Moreover, petitioner does not have any criminal antecedent, accordingly, petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.

Patna High Court CR. MISC. No.66477 of 2019(2) dt.25-10-2019 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Sigori P. S. Case No. 45 of 2019 corresponding Special Case No. 4384 of 2019.
