Petitioner is languishing in judicial custody since 18.02.2017 in connection with Alamnagar P.S. Case No. 102 of 2016 registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code. The prosecution case is, as lodged by the informant, is that his daughter, Seema Devi was married 7 years ago to Fulo Mandal. It is alleged that petitioner, who is the mother-in-law of the deceased, Seema Devi, along with the husband and other in-laws of the deceased on non-fulfilmnt of demand of dowry, has killed the daughter
Patna High Court Cr.Misc. No.24198 of 2017 (4) dt.25-08-2017 2/3 of the informant and dumped her dead body in jungle. It has been submitted by the learned counsel for the petitioner that she is innocent and being mother-inlaw has been falsely implicated. It is submitted that the husband of the deceased, Fulo Mandal is in custody since 07.09.2016 and there is general and omnibus allegation levelled against the petitioner. He submits that chargesheet has already been submitted and there is no allegation of tampering with the prosecution witnesses by the petitioner.
However, learned A.P.P. for the State opposes the prayer for bail stating therein that the petitioner is also involved in the said offence.
Considering the facts and circumstances and the materials on record and that the husband of the deceased is in custody, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Udakishunganj,
