The petitioner seeks bail in connection with Samastipur (Mufassil) PS Case No. 408 of 2023 instituted for the offences punishable under Sections 272, 273, 414 of the Indian Penal Code and Sections 30(a), 36, 37, 41(i) (ii) of the Bihar Prohibition and Excise (Amendment) Act, 2016. As per the allegation, there is total recovery of 177.450 liters of foreign liquor from TVS Scooty and Wagon-R car.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this

Patna High Court CR. MISC. No.73372 of 2023(2) dt.22-11-2023 2/2 case. Nothing has been recovered from the conscious possession of the petitioner. Both vehicles does not belong to the petitioner. Petitioner has no concerned with the alleged occurrence and has been falsely implicated in this case. Petitioner has no criminal antecedent and is in custody since 08.09.2023. Learned APP opposes the prayer for regular bail. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Court, 1st, Samastipur in connection with Mufassil PS Case No. 408 of 2023.
