2. In this case, the petitioner is seeking regular bail in connection with Sessions Trial No. 653 of 2024 arising out of Sherghati (Bahera O.P.) P.S. Case No. 1215 of 2023, registered for the offences punishable under Sections 341, 323, 324, 325, 307, 504, 506/34 of the IPC.

3. Learned counsel for the petitioner is making prayer for bail and submits that earlier, the bail petition of the petitioner was rejected by this Court vide order dated 12.09.2024 in Cr. Misc. No. 33316 of 2024 and it was observed by this Court that the petitioner will be at liberty to renew his prayer for bail, if the trial is not concluded within a period of one year. He has further

He has further submitted that only one witness has been examined till date. His further submission is that co-accused Anil Yadav assaulted the deceased with Garasa on her head, Rajesh Yadav inflicted axe blow on the head of the deceased and the petitioner assaulted her with lathi but according to postmortem report, only one injury has been found on the head of the deceased which was the cause of her death. The petitioner is under custody since 05.12.2023.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge III, Sherghati in connection with Sessions Trial No. 653 of 2024 arising out of Sherghati (Bahera O.P.) P.S. Case No. 1215 of 2023, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
