JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 07-07-2017 Heard the Counsel for the petitioners and Mr. M. Dayal, APP for the State.

Petitioners are facing accusations punishable under sections 341, 323, 406, 498A, 354(a) and 506 of the Indian Penal Code vide Siwan Mahila P.S. Case No. 198 of 2015. Petitioners are not the in-laws of the informant. The allegation against them is that they reached the house when the informant was being tortured by the in-laws and they also abetted the in-laws. It is further submitted that husband has filed a divorce case whereafter F.I.R. was lodged. Referring to the Annexure-2, it is stated that co-accused Pankaj Kumar Singh, who is also not directly related to the husband of the informant, has since been granted privilege of anticipatory bail.

In the event of arrest or surrender in the Court below

Patna High Court Cr.Misc. No.26297 of 2017 (2) dt.07-07-2017 2/2 within four weeks, the petitioners abovenamed are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Siwan in Siwan Mahila P.S. Case No. 198 of 2015 subject to the condition as laid down under Section 438(2) of the Cr.P.C. with the further following conditions:

(i) One of the bailers shall be the own/close family members of the petitioners.

(ii) As soon as the charges are framed, the petitioners shall appear in person on each and every date fixed in the Court below. In case of default in doing so on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioners and secure their arrest in accordance with law (Kishore Kumar Mandal, J) Pankaj/- U T
