JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Punpun P.S.Case No. 378 of 2017, registered for offences punishable under Sections 341, 323, 324, 307, 354, 504, 448/34 of the Indian Penal Code and Sections 25 (1-b)a, 26 and 27 Arms Act and Section 37 (b) (c) of the Bihar Prohibition & Excise Act, 2016.
As per F.I.R., allegation against the petitioners is that in the night when the wife of the informant met with labour pain and he was going to hire a vehicle for taking her in hospital then the petitioners after taking wine try to assault the informant when they objected, the petitioners chased the informant and firing on him, causing head injury and they succeeded to flee away. Submission of the learned counsel for the petitioners
Patna High Court Cr.Misc. No.46002 of 2018 (2) dt.08-08-2018 2/2 is that the petitioners have falsely been implicated in the present case and the F.I.R. itself shows that the allegations against the petitioners are general and omnibus and there is no specific allegation against the petitioners and the petitioners have no criminal antecedents.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named on surrender or arrest within six weeks be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Patna in connection with Punpun P.S.Case No. 378 of 2017, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
