JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Complaint Case No. 924 of 2016, corresponding to Trial No. 3284 of 2019, in which cognizance has been taken under Sections 323, 341, 504, 506, 406 and 34 of the Indian Penal Code.

Allegation against the petitioners is that they got a sale deed executed with respect to land of the complainant from his Patidar and when he went to complain about the same he was threatened.

Submission of learned counsel for the petitioners is

No.69545 of 2019(2) dt.06-11-2019 2/2 that they purchased the land from the original landholder and complainant has demanded extortion from the petitioners and when extortion amount has not been given to him he has falsely been implicated and moreover a title suit has also been filed by the complainant with respect to the same land. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Bagaha, West Champaran, in connection with Trial No. 3284 of 2019, arising out of Complaint Case No. 924 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
