JUSTICE SANDEEP KUMAR ORAL ORDER 16-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Sessions Trial No. 752/2022, arising out of Sabour P.S. Case No. 357 of 2020, registered for the offence punishable under Sections 302/34, 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner has no criminal antecedent. The name of the petitioner transpires in this case on the basis of confessional statement of one co-accused Jyotish Yadav. Similarly situated co-accused persons namely Yogesh Yadav and Kuldeep Sharma have already granted bail by a co-ordinate Bench in Cr. Misc. No. 50167 of 2021 dated 31.03.2022 and Cr. Misc. No. 29783

Patna High Court CR. MISC. No.6943 of 2023(2) dt.16-05-2023 2/2 of 2022. Petitioner is in custody since 22.07.2022. Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge-I, Bhagalpur in connection with Sessions Trial No. 752/2022, arising out of Sabour P.S. Case No. 357 of 2020.
