JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2018 The petitioner is apprehending her arrest in connection with Sahajitpur P.S. Case No. 68 of 2018, registered for offences punishable under Sections 30 and 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016.
Allegation of recovery of 2008.080 litres of wine from a truck and petitioner is said to have been caught by the police. Submission of learned counsel for the petitioner is that identification is itself doubtful as it is not believable that in the torchlight a large number of persons can be identified. Further submission is that there is no compliance of Section 100 Cr.P.C. Heard learned A.P.P. also who has opposed the prayer of anticipatory bail stating that petitioner is named in FIR, apart from that he is also accused in eight other criminal cases including the case registered under the provisions of Excise Act.

No.51274 of 2018(2) dt.13-09-2018 2/2 Having heard both sides and considering the facts that he has criminal antecedents and an accused in a large number of cases, I am not inclined to grant privilege of anticipatory bail to the petitioner. Hence, prayer of bail of the petitioner is rejected. However, if petitioner surrenders and prays for regular bail, the same shall be considered on its own merit considering the fact that other co-accused persons have been granted bail.
