The petitioner seeks bail in connection with Singhwara P.S. Case No.17 of 2017 registered under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that earlier, the prayer of the petitioner for grant of bail was rejected by this Court vide order dated 27.04.2017 passed in Criminal Misc. No.15145 of 2017 with an observation "at present", taking into consideration the allegation against this petitioner that he had identified Md. Fazal as son of Sheikh Safi Alam. Learned counsel for the petitioner further submits that Md.
Patna High Court Cr.Misc. No.33687 of 2017 (2) dt.02-08-2017 2/3 Fazal, son of Md. Sabeer, used to reside at the house of his maternal uncle Sheikh Safi Alam in village-Gaurinath Brahampura, P.S. Sidhwara, District-Darbhanga, as son of Sheikh Safi Alam, and in that conscious, this petitioner on the basis of other documents identified Md. Fazal as son of Sheikh Safi Alam. The petitioner having no criminal antecedent is in custody since 03.02.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Darbhanga, in connection with Singhwara P.S. Case No.17 of 2017. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. Further, the petitioner shall attend the trial court on each and every date fixed in the case during the course of the trial. If the petitioner fails to attend the trial court, on two consecutive dates, during the course of the trial, without any reasonable cause being shown, the trial court would be at liberty to cancel the bail bonds
