Petitioners are apprehending their arrest in connection with Muffasil PS Case No. 188/2018 for the offence under Sections 341, 323, 308, 448, 379, 504/34 of the Indian Penal Code pending in the court of Chief Judicial Magistrate, Munger. Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. He submits that there was old enmity between the petitioners and the informant, and they are neighbours.
Having regard to the fact that the petitioners and the informant are neighbours and there was case and counter-case
Patna High Court Cr.Misc. No.49582 of 2018(2) dt.12-12-2018 2/2 between the parties on account of land dispute as is evident from Annexure-2 series, the Court is inclined to grant them bail. Considering the aforesaid, the petitioners above named, in the arrest or surrender before the court below within one month from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in connection with Muffasil PS Case No.188 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
