JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-08-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners, apprehending their arrest in connection with Maner P.S. Case No. 270 of 2016 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 354, 379, 384 and 385 of the Indian Penal Code, seek the privilege of prearrest bail. Allegedly, the petitioners and others F.I.R. named accused persons after forming an unlawful assembly came at the house of the informant and co-accused Ramadhar Rai misbehaved with his daughter and assaulted her by means of pistol. The petitioner No. 1 snatched gold chain from the neck of the daughter of the informant.

Submission is of false implication and that against the

Patna High Court Cr.Misc. No.35348 of 2017 (2) dt.11-08-2017 2/2 petitioners there is no allegation for committing assault. The allegation under Section 379 of the Indian Penal Code is super addition. There is case and counter case between the parties. The victim has not sustained serious injury and the Doctor of the P.M.C.H. sent her to the house after prescribing medicines. Other co-accused Vijay Kumar and Ranvijay Kumar @ Ranvijay Singh have been allowed pre-arrest bail vide Cr. Misc. No. 19428 of 2017 by another coordinate Bench of this Court and, as such, the petitioners also deserve sympathetic consideration. The learned A.P.P. fairly submits that other coaccused have been allowed pre-arrest bail.

In the facts and circumstances as stated above, the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of the copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Danapur in connection with Maner P.S. Case No. 270 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
