The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 and 120B of the Indian Penal Code.
Allegation is that the petitioner was an agent of the Bank and he had persuaded the informant to manage Kishan Credit Card Loan for the informant. Loan was sanctioned and disbursed but the same was not disbursed to the informant. This fact informant came to know only after service of notice of recovery.
Submission is that false allegation is there. The petitioner has got no criminal antecedent. Co-accused, Akhilesh Chaudhary has already been allowed anticipatory bail by this
Patna High Court Cr.Misc. No.52979 of 2018(2) dt.17-12-2018 2/2 Court in Criminal Miscellaneous No.54587 of 2018. Considering the facts aforesaid, especially the fact that petitioner has got no criminal antecedent and the fact that co-accused, Akhilesh Chaudhary has already been allowed anticipatory bail by this Court, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Bagaha (Pathkauli) Police Station Case No.62 of 2011, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
