The petitioner apprehends his arrest in Choraut P.S. Case No.57 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The learned counsel for the petitioner submits that recovery was made from the hut which belongs to the joint family and recovery is not made from conscious possession of the petitioner but the prosecution report shows that informant got secret inputs that it was petitioner who kept liquor in his house and on such, a raid was conducted and from the house of the petitioner, 6.750 liters of Indian made foreign liquor was recovered.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
