2. Petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case No. 218 of 2019, registered for the offence punishable u/s 406, 506, 34 of the IPC, pending in the court of learned CJM, Saharsa.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if petitioner surrenders before the learned Court below within six weeks from today and seeks regular bail,

Patna High Court CR. MISC. No.76258 of 2024(2) dt.18-11-2024 2/2 the learned Court below shall pass order on the same day in accordance with law without being prejudiced by this order considering the fact that one of the co-accused has been granted regular bail by the learned Court below.
