2. The petitioners seek bail in connection with Special Excise No. 396 of 2024 (arising out of Bounsi P.S. Case No. 263 of 2024) registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per the prosecution case, the recovery is of 1071 liters of foreign liquor.

4. It has been submitted by the learned counsel for the petitioners that the petitioners are innocent and they are in custody since 15.08.2024.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Court No. 1, Banka in connection with Special Excise No. 396 of 2024 (arising out of Bounsi P.S. Case No. 263 of 2024).

7. As a condition of this order, the petitioner No. 1 is directed to mark his attendance at Salalpur Police Station District Bardhwan (West Bengal) and the petitioner no. 2 is directed to mark his attendance at Masaliya Police Station, District Dumka, Jharkhand on first and third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioners.

8. Let a copy of this order be communicated to the Superintendent of Police, Bardhwan (West Bengal) and Superintendent of Police, Dumka (Jharkhand) through FAX for its compliance forthwith.
