2. The petitioner is apprehending his arrest in connection with Barun P.S. Case No.163 of 2024, lodged on 09.04.2024, for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. As per the prosecution, recovery of 7.5 liters of wine has been made from the house of the petitioner which is subject matter of the present case.

4. Learned Counsel for the petitioner submits that petitioner is innocent and has committed no offence. Counsel submits that the recovery was made from the joint house of the petitioner. Counsel submits that the police has falsely named the petitioner in three more cases.

5. Learned Additional Public Prosecutor for the State opposes the prayer for bail and submits that the petitioner is habitual offender. He is accused in three criminal cases of the same nature.

6. Considering the criminal antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner within four weeks from today, the prayer for regular bail shall be considered without being prejudiced by the order of this Court.
