The petitioner seeks bail in connection with a case registered for the offence punishable u/s 30(a) of Bihar Prohibition and Excise Act, 2016.

Altogether, 100 litres of illicit liquor is said to have been recovered from the motorcycle of the petitioner. 4.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has been implicated in this case due to ulterior motive. No such occurrence, in the manner as alleged has taken place and the whole allegation is concocted. It is further submitted that no incriminating article has been recovered from the conscious physical possession of the petitioner nor he has any concern with the alleged recovery. The
Patna High Court CR. MISC. No.71910 of 2025(2) dt.09-10-2025 2/2 recovery is said to have been made from a motorcycle but the same does not belong to the petitioner. He is neither the owner nor the driver of the seized motorcycle. The petitioner is languishing in custody since 12.07.2025.

Learned APP for the State opposed the prayer for bail.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court, Excise-2, Gaya, in connection with Excise P.S.
