The petitioner apprehends his arrest in connection with Bachhwara P.S. Case No. 124 of 2019, registered under Sections 30(a)/32 of the Bihar Excise Act, 2016.

The accusation is that on receiving secret information about unloading of illicit liquor from the truck on the road connecting to village Fateha and Sherpur by Pradeep Singh (petitioner), Rohit Choudhary and Shubham Chaudhary along with others, the informant along with other police personnel reached there. On seeing the police party, the persons present near the truck bearing registration no. HR589120, started to flee away, but on chased, one person was apprehended, who disclosed his name as Paltu Sah and also disclosed that cartoons of liquors are being carried through truck

Patna High Court CR. MISC. No.64257 of 2019(2) dt.22-10-2019 2/2 on the instruction of Munsi Sona Babu, whose mobile number is 8250566893. On search, 181 cartoons each containing 418 bottles of 375 ml Indian made foreign liquor were recovered from the said truck.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner was not apprehended at the spot but the name of petitioner and two others have surfaced in the F.I.R. mere on suspicion. In fact, apprehended person, Paltu Sah, has not disclosed the name of this petitioner.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai, in connection with Bachhwara P.S. Case No. 124 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
