Misc. applications have arisen out of the same P.S. case and as such they have been heard together and are being disposed of by passing this common order.

2. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

3. The petitioners seek bail in connection with Excise

Patna High Court CR. MISC. No.72126 of 2025(2) dt.13-10-2025 2/3 P.S. Case No. 917/2025 registered for the offences punishable under Sections 30(a), 32(iii) of the Bihar Prohibition and Excise Act.

4. As per the prosecution case, on 21.08.2025 the police intercepted a black colour Scorpio and arrested two persons who are drivers of the said vehicle. On search of the said Scorpio, police recovered 380.160 liters of foreign liquor.

5. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Learned counsel further submits that the petitioners are driver and passenger and not the owner of the said seized Scorpio and they were driving the said Scorpio on the instruction of the owner. Learned counsel further submits that no incriminating article was recovered from their conscious possession. Learned counsel further submits that petitioners have clean antecedent and they are in custody since 22.08.2025.

6. Learned APP for the State has opposed the prayer for regular bail of the petitioners.

7. Considering the facts and circumstances of the case, these applications for regular bail are allowed.

8. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten

No.72126 of 2025(2) dt.13-10-2025 3/3 Thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No.-III, Gaya in connection with Excise P.S. Case No. 917 of 2025 subject to the condition:- (i) One of the bailors should be local and other should be close relative.
