The short prayer made by the petitioner in the present case is to direct the Circle Officer, Parsa, District-Saran at Chhapra to dispose off the pending Encroachment case no. 01 of 2021-22 by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956 (hereinafter referred to as "the Act, 1956").

The learned counsel for the respondent- State submits that in case, the aforesaid encroachment proceedings are still pending, the same would definitely be concluded within a fixed time frame.

Having regard to the facts and circumstances of the

Patna High Court CWJC No.911 of 2023(2) dt.19-09-2023 2/2 case, I deem it fit and appropriate to direct the Circle Officer, Parsa, District Saran at Chhapra to conclude the proceedings of the aforesaid Encroachment case no. 01 of 2021-22 by passing the final order under Section 6(1) of the Act, 1956, after hearing the affected parties and in accordance with law, in case the same has not already stood concluded, within a period of six weeks of receipt/ production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
