JUSTICE SANJAY PRIYA ORAL ORDER 2/ 02-08-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The Petitioners seek bail in Hussainganj P.S. Case No.113 of 2017 instituted for the offence under Section(s) 272, 273, 308 Indian Penal Code and Sections 41(1), 30, 36, 38, 62 of the Bihar Excise Act, 2016.

It has been submitted that the petitioners have clean antecedents. They are in custody since 20.05.2017. As per written report, 21 litres of foreign liquor has been recovered from the house of petitioner No.1, whereas, 12 litres of foreign liquor has been recovered from the house of petitioner No.2.

Keeping in view the clean antecedents of the petitioners and the period spent by them in custody, prayer of the

Patna High Court Cr.Misc. No.35456 of 2017 (2) dt.02-08-2017 2/2 petitioners for grant of bail is allowed. Let the Petitioners, above named, be released on bail on furnishing bail bond of `10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge, Siwan, in connection with Hussainganj P.S. Case No.113 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioners.
