Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420/34 of Indian Penal Code and Section 10 of the Bihar Examination Control (Conduct) Act.

As per prosecution case, all the F.I.R. named accused persons including this petitioner were trying to appear at the matriculation examination in place of actual candidates. It is a case of impersonation.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has been made accused on the basis of statement of co-accused who was apprehended on the spot on the allegation that admit card of the petitioner was recovered from the possession of one of the accused persons. It

Patna High Court CR. MISC. No.75154 of 2022(2) dt.24-03-2023 2/2 is submitted that admit card of the petitioner had misplaced and the same was preserved by the accused person. No stolen or any incriminating article has been recovered from his possession or premises. Petitioner claims clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Nalanda, Bihar Sharif in P. S. Case No. 88 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
