JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bodhgaya P.S. Case No. 43 of 2019 registered for the offences punishable under Sections 147, 149, 323, 337, 307, 333, 353, 379, 504, 506 of the Indian Penal Code and Section 45 of Bihar Prohibition and Excise Act. As per FIR allegation against the petitioner is that he misbehaved and abused the Excise Inspector and also confined him and thereafter police reached there in information. Submission of learned counsel for the petitioner is that he has falsely been implicated and he has no criminal antecedent.

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner.

Patna High Court CR. MISC. No.64771 of 2019(2) dt.17-10-2019 2/2 In view of allegation, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail.
