The petitioners apprehend their arrest in connection with Forest Case No. 26 of 2017 instituted under Sections 9 and 50 of the Wild Life Protection Act, 1972.

The allegation, in brief, is that some villagers were driving away a deer which crossed over the road and came under the wheel of a vehicle got injured thereafter they killed it and the forest officials recovered the head and leg from the possession of Lala Bind and meat of the deer from the house of one Santu Sah and Lala Bind disclosed the names of other villagers including this petitioners.

Learned counsel for the petitioners submits that

No.37832 of 2017 (2) dt.16-08-2017 2/2 except the disclosure of the names of the petitioners by Lala Bind that they too were driving away the deer, there is no other material against them and the petitioners have got no criminal antecedent. Having considered the aforesaid facts and circumstances, let the petitioners, namely, Santosh Kumar Singh @ Santosh Singh, and Gurudev Jaiswal @ Gurudeo Kumar Jaiswal, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Forest Case No. 26 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
