The petitioner seeks bail in connection with Amas P.S. Case No. 180 of 2019 registered for the offence punishable under Sections 30(d), 56(b) of Prohibition of Bihar Excise Act, 2016.

As per allegation in the FIR, 160 Kg. Mahua flower has been recovered from the back seat of tempo which was being driven by the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is a licensee tempo driver. He has no concern with the recovered bags of mahua flower. The seized bags belongs to passengers. He has no criminal antecedent. Petitioenr is in custody since 16.09.2019.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.65279 of 2019(2) dt.04-11-2019 2/2 and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Gaya in connection with Amas P.S. Case No. 180 of 2019.
