2. The petitioner seeks bail in a case registered for the offence punishable under Sections 309(4) of the B.N.S.

3. The allegation in the first information report is that two unknown motorcycle riders snatched the jewelry and Rs. 5000/- cash from the informant who was sitting in auto-rickshaw.

Learned counsel for the petitioner submits that the first information report is against unknown and the name of the petitioner has transpired in this case on the basis of confessional statement of co-accused Rupesh Kumar and subsequently his own confessional statement was also recorded but till date, he has not been put up on test identification parade for identification. Further there is no direct allegation or evidence connecting the petitioner to the offence and co-accused Sagar Soni from whose possession

No.70734 of 2025(3) dt.17-11-2025 2/3 recovery has also been made, as he was a purchaser of the jewelry, has already been granted bail by a coordinate Bench of this Court vide order dated 20.08.2025 passed in Cr. Misc. No. 40744 of 2025. The petitioner is in custody since 08.04.2025 and charges have been framed on 10.07.2025.

Learned APP for the State has opposed the application for bail to the petitioner on the grounds mentioned in the first information report and also on the ground that the petitioner has several criminal antecedents. However, it has been submitted that the petitioner is being remanded in several cases only on the basis of his criminal antecedents.

Taking into consideration the facts and circumstances and also considering the fact that the only material available against the petitioner is the confessional statement before the police, which have no evidentiary value coupled with the fact that there is no recovery from his conscious possession and also he is in custody since 08.04.2025 with charges having been framed, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Khaira P.S. Case No. 60 of 2025, subject to the conditions that:

(II) The petitioner would appear physically on each and every date in the learned court below and would cooperate in the conclusion of trial and if the petitioner does not appear on two consecutive dates without any substantial and satisfactory reason, the learned court below would be at liberty to cancel his bail bonds.
