====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-08-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Nadi P.S. Case No. 12 of 2017, GR No. 976 of 2017 registered for the offence punishable under Section 395 of the Indian Penal Code.

The case of the prosecution, in short, is that some unknown miscreants had entered into the warehouse of Samsung mobile phone of the informant, had tied rope around the guards present there and thereafter they had stolen the articles kept in the warehouse and had taken away the same by means of pickup van. The learned counsel for the petitioner submits that the petitioner has been apprehended merely on the basis of suspicion and only one mobile phone, said to have been stolen, has been

No.37944 of 2017 (2) dt.10-08-2017 2/2 recovered from his possession and only thereafter, he was remanded in three other cases, otherwise the petitioner has a clean antecedent. It has been further submitted that during the course of investigation it has come to light that the said mobile phone was of his relative. It has been submitted that the petitioner is languishing in jail custody since 24.04.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail after completion of six months of his custody.. It is directed that the learned trial court shall enlarge the petitioner on regular bail immediately upon completion of six months from 24.04.2017 on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM, Patna City in connection with Nadi P.S. Case No. 12 of 2017, GR No. 976 of 2017 on such other terms and conditions as the learned trial court may deem it fit and appropriate.

With the aforesaid observations, this application is disposed of.
