The petitioners apprehend their arrest in connection with Buxar (Town) P.S. Case No. 448 of 2022, registered for the offences punishable under Sections 420, 467, 468, 471, 472, 120B of the Indian Penal Code.

Submission of learned counsel for the petitioners is that petitioners are innocent and have falsely been implicated in the present case. There is land dispute between the parties. Petitioners are purchaser of the disputed land. Further he submits that title suit is also pending between the parties. It is a case of purely civil in nature.

Patna High Court CR. MISC. No.72689 of 2022(2) dt.20-02-2023 2/2 Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioners by contending that both the petitioners have criminal antecedent. This is not a fit case for grant of anticipatory bail.

Having considered the facts and circumstances of the case as well as the submissions advanced on behalf of the learned Additional Public Prosecutor, the prayer for grant of anticipatory bail of the petitioners is rejected. The petitioners are directed to surrender before the court below and pray for regular bail, which shall be disposed of on the same day, without being prejudiced by this order. shailendra/- (Arvind Srivastava, J) U T
