====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-11-2019 Heard learned counsel for the petitioners, the learned counsel for the informant and learned Additional Public Prosecutor for the state.

The petitioners seek pre-arrest bail in connection with Khagaria P.S. Case No. 636 of 2019 registered under Sections 406, 409, 420 and 34 of the Indian Penal Code. The accusation is of taking money from the informant.

The submission of the learned counsel for the petitioners is that it would appear from the first information

Patna High Court CR. MISC. No.66610 of 2019(2) dt.13-11-2019 2/2 report that Rs.5,00,000/- is said to be transferred through the RTGS from the account of the father of the informant in the account of Bhaskar Gupta and later on cash of Rs.2,00,000/- was also given to him, but, petitioner no. 1, who is brother-inlaw, and petitioners 2 and 3, who are staff of the informant, have falsely been implicated in this case.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Khagaria P.S. Case No. 636 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
