ANJANA MISHRA ORAL ORDER 18-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 17.07.2019, in connection with Motipur P.S. Case No. 279 of 2019 for the offenses under Sections 399, 402/34 of Indian Penal Code and 25(i-b)a, 26, 35 of Arms Act.

Learned counsel for the petitioner submits that the allegation against the petitioner is merely on the basis of suspicion. Alleged recoveries were made from the Auto and only because the petitioner was there on the motorcycle, he has been taken into custody in connection with recoveries made from the Auto. Learned counsel for the petitioner submits that admittedly the petitioner was not arrested on the spot and nothing has been recovered from his possession.

Case No. 279 of 2019.
