21-09-2017 Heard Sri Ramesh Kumar Singh, learned counsel for the petitioner and Sri Abhay Kumar Roy, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in connection with Forbesganj P.S. Case No. 159 of 2017 registered for offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.

It was submitted by learned counsel for the petitioner that on false accusation, the petitioner has been made accused, as if, the petitioner alongwith one another accused, after noticing the police party threw motorcycle carrying about 30 liter of Nepali country-made liquor, fled away. Learned counsel for the petitioner submits that save and except suspicion, there is

Considering the nature of accusation and clean antecedent of the petitioner, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Pawan Kumar Mandal be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P. S. Case No. 159 of 2017, subject to condition as laid down under Section 438(2) of the Cr.P.C.
